This website is operated by DFW Custom Imprints. Throughout the site, the terms “we”, “us” and “our” refer to DFW Custom Imprints. DFW Custom Imprints offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. 

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

 

TERMS

By paying your invoice you are agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

 

Satisfaction Clause

DFW Custom Imprints will not be responsible for your satisfaction with the garments or products printed on or the printed artwork, as satisfaction is subjective to opinion. We are always available to advise any customer to ensure you pick a garment that matches your needs, but we also need you to do your due diligence on the garment choice. If you are unsure of what garment to select, we can gladly order a number of blank samples for you to choose from. The samples will be billed at a per piece rate and shipped without printing. Blank samples will not credit to the cost of your order unless specified at the time of your order.

 

Claims & Reprints

We go to great lengths to try to ensure that every order that leaves our facility is correct. All our customers are valued customers, regardless of size, and we want you all to know that. Any order printed differently (a different design) than the mock-up approved will be granted a reprint of the defective product. All claims must be submitted within 48 hours of date of delivery. Please email us at info@dfwcustomimprint.com to submit your claim. If DFW Custom Imprints is responsible for any errors in your order, we will gladly accept responsibility for the issues and will reprint the garments printed in error (order must be paid in full). We do not offer refunds. We will gladly reprint any production errors that exceed the spoilage rate stated in these Terms.

We will require that you ship or return the misprinted items to the address stated in these Terms. DFW Custom Imprints will not be responsible for any items sold or given away prior to returning the order. Please also note that if you purchased items printed on a manual press (at live events), there is an allowable variance of 20% in imprint size, shape, color, location, and positioning between prints. If a large reprint claim must be filed, please return or submit photographs of all items to be considered for a reprint within 48 hours of date of delivery. We will need 7 business days to review your claim and will reproduce & deliver the approved reprints within 15 business days.

 

GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

Orders must be paid in full before the order begins unless otherwise approved by DFW Custom Imprints staff. If you pay via check, the turnaround time clock on your order will not begin until your check clears.

Example: Acme, Inc. emails DFW Custom Imprints about placing a T-Shirt order. DFW Custom Imprints sends Acme a Quote. Acme approves the quote and DFW Custom Imprints sends an Invoice. Acme waits 3 weeks, then pays for the order. Once payment is received, DFW Custom Imprints places the order on the schedule.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

 

Turnaround

The turnaround time on your order with DFW Custom Imprints starts when you’ve paid in full, we have all information required to complete your order (all artwork, correct tag files, all fonts required for editable tags, all shipping info, etc.) & your Mocks have been approved. Delay in receipt of *any* of this info could result in production delays. Most Mocks are sent within 48 business hours, after receiving payment and all necessary information. Our current turnaround time is 4-10 Business Days Average + Shipping. Complex orders/add-ons may increase turnaround. Delay in approval of mockups could also result in production delays. Each finishing service (printed tags, hem tags, etc.) will add extra time to the turn around on orders, adding roughly 3 days per finishing to the turnaround time. The most up-to-date turnaround time will be listed on your quote and invoice. 

If you have a deadline for your order, it is very important that you let us know when placing your order and a rush fee may apply if there is not enough time to complete your order under normal circumstances. If you do not advise us about a due date until after your order has been paid for and pushed through our system, we may not be able to accommodate your request. Any circumstances out of DFW Custom Imprints control (i.e.: weather delays, shipping errors by the supplier, etc.) may also require more time and are not factored into the initial turnaround time estimate.

 

Spoilage 

All orders over 144 pieces are subject to a 2% spoilage allowance; water based is subject to 3% spoilage allowance. All orders under 144 pieces are subject to a 3% spoilage allowance. Discharge printing is subject to a 5% spoilage allowance. Spoilage percentage is calculated by percentage multiplied by the number of imprints or 1 piece whichever is greater.

Disclaimer: Polyester is subject to dye migration; this can happen up to two weeks after merchandise is printed and cured. Colors most vulnerable are red, maroon, green and dark blues. Customers take all risk for dye migration in polyester blends. It is the responsibility to order the correct quantities and provide additional blanks if necessary. If exact quantities are necessary, we recommend ordering with spoilage allowance in mind.



Rush Orders and Proofs

Proofs are waived on any RUSH ORDER and printing is done to what is given to be printed there are NO REFUNDS on RUSH orders or Custom Printed Products.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

 

Art Approval | Order Proofing

All artwork is to be approved via a digital mock-up through email. Artwork must be checked for spelling, color, sizes ordered, placement of the art and accuracy of artwork by the customer. It is very important to look over every detail of the mockup, as this is how your garments will print. DFW Custom Imprints will not accept responsibility for corrections not implemented and/or requested after artwork approval. Any modifications requested after customer approval will result in production delays and could require additional expenses. Any delays in the approval process longer than 24 hours after receipt of the mockup could result in production delays.

Art Resolution Requirements

All artwork, designs and images must be provided in minimum of 300 DPI and CMYK color mode. DFW Custom Imprints is NOT RESPONSIBLE for images printed as fuzzy, distorted, or pixilated due to low resolution artwork provided by the customer, especially if it is approved by the customer already. DFW Custom Imprints is also not responsible for any color shift that occurs in conversions from RGB to CMYK color modes.

 

CUSTOMER SUPPLIED GARMENT / PRODUCT POLICY

The customer’s garments (or other articles) are accepted on the strict understanding that DFW Custom Imprints will not accept any liability whatsoever for any misprints, stains, and damage to the customer supplied garments or product. DFW Custom Imprints’ printing process and other decorating techniques, such as screen printing and embroidery, involve high heat and other treatments that may impact the quality of the decoration and the item to be decorated. In addition, there is some risk that printer and human errors will occur. All garments or products are left entirely at the customer’s own risk.

If you supply the garment (or other articles) and there is a problem, we do not replace your item nor reimburse you for the item’s value. Your damaged piece will be returned to you with an apology. This is why we prefer to work on garments from our suppliers that DFW Custom Imprints knows will work for your needs and may be easily replaced should a production error occur.

When presenting your own garments or products for decoration, you will be required to sign a waiver indicating your acceptance of these terms before we will decorate them.

 

Shipping

DFW Custom Imprints cannot be responsible for any shipping delays caused by the shipping company. 

Examples: UPS cannot deliver your package on time due to inclement weather. | UPS delivers your package to the wrong address (although provided the correct address) and you do not receive your products on time.

 

Refund / Returns

Please check your order immediately upon receipt. All claims must be reported within thirty (30) calendar days upon receive of goods. Should you file a claim within thirty (30) calendar days of your receipt of your ordered goods, we will process that claim and send you a resolution. Resolutions will be sent via e-mail. You will then have five (5) business days upon the delivery of that resolution to confirm the resolution or take any additional prescribed action. If we do not hear from you within that period of five (5) business days, your claim will become invalid.

Due to the customized characteristics of the products, we cannot restock customized products. Therefore, we do not allow cancellations, exchanges, or refunds. If upon delivery of the product you feel that your order was incorrect due to error on our part, such as a misspelling, the wrong color, item size, or design, please email us within thirty (30) days of your delivery. Claims will be handled on a case-by-case basis. You acknowledge and agree that goods produced by us for you are bespoke, custom-made goods. Other than where goods are faulty, you have no right to cancel any order or return any goods and all orders are final.

By making the purchase you acknowledge and agree that the goods are bespoke, and made specifically for you, they are custom-made goods, and are produced only after your purchase has been made and confirmed. Oftentimes, prior to your purchase, no stock of the purchased goods exist. Furthermore, based on the information written above—and unless otherwise indicated—you acknowledge and agree that your rights to make changes or cancellations are within 24 hours from your purchase confirmation. Once the 24 hours has elapsed and your purchase goes into production, your rights to make changes or cancellations are forfeit. Other than where goods are faulty, you have no rights to cancel any order or return any goods purchased and all orders are final.

Returns are handled on a case-by-case basis. If you receive merchandise that you believe is defective or of unacceptable print quality, you can email  to send us three or more pictures of the product within thirty (30) days of delivery. For claims regarding issues with colors, we will require a sample to be mailed to us. Please provide pictures from different angles for clear verification. We will have a Claims Representative review the reported issue, and, upon verification of an error, we will make every attempt to promptly re-do the order exactly as you had originally requested and in accordance with standard production and shipping timelines. We will not change the product, the logo/artwork, or the imprint color when processing the re-do. Note that you may request expedited shipping of a re-produced order for an additional charge. Any request for a re-do or refund beyond sixty (60) days after delivery will be denied.

When a re-do is no longer practical or even feasible (either due to event date timelines, stocking or quantity issues), DFWCustomImprint.Com will issue a store credit for up to the same value as the original order, minus any shipping fees. Shipping charges will not be credited back, as those charges are made on behalf of the shipping company. The store credit may be treated as cash, and it may be used at any time and on any product we stock.

We only provide refunds for custom products if a Claims Representative determines that we made a mistake on the order that cannot be remedied by a re-make. In some instances where we do not determine that we are at fault, we may, within our discretion, grant a courtesy refund, not to exceed the shipping cost you paid for your order. This also applies to discretionary cancellations that we grant after an order is already in production. If a cancellation is requested after an order is already in production and in the process of being customized, we may grant a courtesy refund of the shipping cost.

Blank products can be returned to us for a full refund minus the shipping cost. You will also be responsible for the shipping costs of returning the order to us.

Any order with used or distributed products is not eligible for refunds or a money-back guarantee.

Qualified Claims and Requests will be refunded back via the original payment method. No credit card or check refund will be available for transactions that are more than thirty (30) days’ old. Only store credit can be offered at that point. Each check refund will incur a $25 processing fee, which will be deducted from the qualified refund amount. If your order is originally paid with a combination of payment methods, such as Store Credit, Reward Credits, Credit Card, and/or Check, you will receive a refund or credit back to the original payment method(s), for transactions within 90 days. If the order originally paid with a combination of payment methods and qualifies only for a partial refund or discount, we will issue a refund in the following priority: Store Credit, Reward Credits, Credit Card, and Check.

If your order is being returned due to any reason, the package(s) will be kept in the facility for 20 days and will then be recycled or donated. Any reshipping request when the order is still in facility will require a re-shipping fee. Any re-shipping request after the order has been recycled or donated will require a new order to be placed and paid for.

We will re-produce an order upon receipt/confirmation that a shipment was lost by the carrier. The order will be re-done in the same manner the order was originally placed.

Return of your purchase is permitted ONLY when the goods delivered fall under the following criteria:

    • The message/artwork does not match the order;
    • The item is the wrong size from the one ordered;
    • The item is the wrong color from the one ordered;
    • The item is the wrong design from the one ordered; and
    • The item is the wrong style (e.g., long sleeve shirt instead of tee shirt) from the ordered.

If the goods delivered to you fall under one of the criteria noted above, please follow below steps to request return:

    • You must submit a request for a return within thirty (30) days after you receive your product(s);
    • After the thirty (30) days have elapsed, you acknowledge that your rights to return are considered forfeit; If product(s) are returned prior to submitting your request, those product(s) are considered forfeit.
    • The request can be made by emailing us at help@dfwcustomimprint.com; and
    • The package should be returned to us at: 3710 Rawlins St Ste 1420 Dallas, TX 75219.

 

Pursuant to industry standard, if the quantity to be replaced is LESS than 10% of the entire order, volume-wise, we reserve the right to process a credit for that amount, rather than undertaking a re-do for that portion. That is, no re-dos will be permitted for missing or defective products, if the amount in question is less than 10% of the order’s total volume. 

 

 

Returned Checks

There will be a $45.00 returned check fee.

Pricing

DFW Custom Imprints reserves the right to change pricing without notice. Please note that although the DFW Custom Imprints website lists prices, these may not always reflect the final price on your quote and invoice. Fluctuations in pricing may be due to increases in garment, ink, labor, or many other cost influencing factors. 

Example: Frank looks at the pricing on DFW Custom Imprints’ website on Monday. On Tuesday, DFW Custom Imprints changes the pricing on their website due to rising cotton prices. Later that day, Frank contacts DFW Custom Imprints unaware that the prices have changed since the day before. Frank places an order and is charged the most up-to-date pricing. 

Past Due Accounts

Customers on terms or have open invoices may acquire a late fee of $25.00 or 15% whichever is greater and will incur each  month until the past due amount or account is brought current.

ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

 

MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. 

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. 

We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.

 

PRODUCTS OR SERVICES

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products or ink/print colors that appear online. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

 

CHANGES, CANCELLATIONS & RESTOCKING FEES

Cancellations made after order has been placed will be subject to a 25% restocking fee plus any additional fees required to cover services already rendered. No cancellations will be accepted once in production or any manipulation of the garments (tag removal, printed tags, printing, hem tagging, etc.) has begun on any order. 

Example: Acme places an order for 99 shirts. DFW Custom Imprints then orders the shirts to prepare for printing. Two days later, Acme needs to cancel the order (for any reason). DFW Custom Imprints has to return the shirts to the manufacturer, incurring shipping fees and restocking fees. DFW Custom Imprints refunds Acme for their order minus necessary cancellation fees.

Any change made to your order after payment that is not due to a stock issue on behalf of the stock suppliers will be subject to a change fee of $50.00 in addition to the additional costs to make the changes. Any changes to your order after it has been placed will delay your order, even if you have paid a rush fee and/or have given us a required date. It is very important that you do not place your order until you are certain that's what you want. Once the process begins, everyone in our shop starts to work on different aspects of the job, changes become costly and time consuming.

Example: Acme places an order for 100 Anvil 980 shirts in Black. DFW Custom Imprints then orders the shirts to prepare for printing. Two days later, Acme wants to change the order to now print on 100 Anvil 980 White tees. DFW Custom Imprints has to re-write the order and ship the black shirts back to the supplier (paying a 25% restocking fee + shipping costs) then pay to have them ship new shirts out.

 

INTELLECTUAL PROPERTY RIGHTS

DFW Custom Imprints is committed to the appropriate and legal use of the intellectual property of others, and we require our users to behave similarly. Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs and written and other materials that appear on the Website (collectively the "Contents") are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled, or licensed by us.

Trademarks made available through this Website, including logos, slogans, color schemes and design trademarks, are licensed for use by us from Institutions and other third parties (the "Licensed Marks"). By using the Website, you agree to limit your use of Licensed Marks to uses that are directly related to such third parties and to comply with any restrictions or conditions imposed on the use and access of the Licensed Marks by the third parties. DFW Custom Imprints will notify you of such terms if your usage is in violation of such terms.

Generally, products created using images available on the site should not be resold commercially. In the event that you wish to resell such products, you agree to contact us and verify the legality of reselling such products prior to doing so. Designs created using the text tools and images available through the site are in no way the exclusive property of the customers who assemble such designs. We retain the right to display such designs or offer them (or variations of such designs) to other customers.

Additionally, we have the sole discretion to reject any order whose design is considered libelous, defamatory, obscene, profane (according to standards established by the FCC), portrays irresponsible use of alcohol or other substances, potentially advocates for or incites violence of any kind, advocates persecution based on gender, age, race, religion, sexual identity, disability or national origin, contains explicit sexual content or is otherwise inappropriate for our production.

You agree to not use our website or Service to create any material that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, or that infringes on any patent, trademark, trade secret, copyright or other proprietary rights of any third party.

 

OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools” as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. In no case shall DFW Custom Imprints, our directors, officers, employees, affiliates agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. You agree to indemnify, defend and hold harmless DFW Custom Imprints and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

 

ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website.

Limited Liability Clause

It is agreed by purchasing services from DFW Custom Imprints, that the Buyer and the Company acknowledge and agree that the Company will not be liable for any losses or damages, whether indirect, incidental, special, or consequential, in profits, goods or services, irrespective of whether or not the Buyer has been advised or otherwise might have anticipated the possibility of such loss or damage. 

 

OWNERSHIP OF ARTWORK AND DIGITIZED FILES

While you own the right to control the use of your logo, all artwork and digitizing created by DFW Custom Imprints remains the property of DFW Custom Imprints. All electronic files created by DFW Custom Imprints will remain the property of DFW Custom Imprints for our exclusive use in executing your orders.

  

Because it is our policy to render art services for production orders solely on a cost recovery basis, any transfer to the client of rights to creative works and materials prepared or contracted by our personnel is subject to reasonable release fees commensurate with the creative services rendered and at a value as determined solely by us.

 

RANDOM SAMPLE OF PRODUCTS POLICY

 

All sample requests must be emailed to sales@dfwcustomimprint.com with the product number, shipping address, and shipping account number for us to ship the sample on. We do not take sample requests over the phone.

Samples requested and the amount are not guaranteed, we will send what we have in stock at the time.

Samples will ship the next business day after the request was made and confirmed by our team.

Due to the number of sample requests, we receive, not all samples are free.  Some of our higher priced products do have a sample fee. We will confirm the price and availability once sample request is submitted through email.

 

We will issue a credit toward the account for the sample fee if order is placed within 30 days or sample request.
